BusyLittlePlay Terms & Conditions

RENTAL PERIOD

 

The agreed rental date and start and end times will be secured upon receipt of the retainer. Once the retainer is paid, this confirmation becomes a binding agreement, and the rental period will officially commence on the specified date and time as agreed upon by both parties. 

 

EQUIPMENT RENTAL PAYMENT

 

Busy Little Play agrees to rent the item(s) outlined in the provided quote for the specified rental period. The Client acknowledges that the payment of the retainer is required to secure the time and date exclusively for their booking. The remaining balance must be paid no later than two weeks prior to the booking date, unless an alternative payment plan has been agreed upon in writing between the Client and the Owner.

DELIVERY FEES

 

Travel 15 km from our base in Hillcrest 4118 will be free. Any location beyond that will be charged at a rate of $10 every 5 km starting at $49 (e.g. 15 km - 20 km = $49 and 20 km - 25 km = $59) If you are located more than 50 km away, please contact us for a custom quote. This is for a round/two-way trip. Where such costs are incurred, they will be added to the final bill. The Client agrees to provide Busy Little Play with access to the event venue to drop off, set up, and pick up the rental equipment.

 

RECEIPT OF RENTAL EQUIPMENT

 

The Hirer agrees to inspect the rental equipment during the installation and prior to their use. The Hirer acknowledges that safety and operation guidelines and instructions are provided. The Hirer must read all these instructions before using the equipment. The Hirer agrees that all rental equipment must not be rented, sold, or removed from the delivery address specified on the first page.

 

RETURN OF EQUIPMENT

 

Busy Little Play Pty Ltd retains ownership of all rental equipment provided unless stated otherwise. The Hirer shall not modify or alter the rental equipment. The Hirer shall be responsible for and reimburse the full cost of repair or replacement for any damages, losses, or theft of the rental equipment that occurs when the equipment is in the Hirers possession. This excludes damage from normal "wear and tear" of the equipment, which refers to ordinary deterioration resulting from the proper use of the equipment.

 

SAFETY AND OPERATING INSTRUCTIONS

 

The Hirer agrees to read the instructions and use the equipment according to the safety and operating instructions provided for the equipment delivered. The Client acknowledges that there is a risk of damage or injury with the use of the soft play equipment and agrees to be responsible for the safe and correct operation and use of the soft play equipment. The Client agrees not to use the soft play equipment in unsafe conditions.

 

WEATHER CONDITIONS

 

The soft play equipment should not be used during rain, strong winds, thunderstorms, or other weather conditions that could pose a safety risk. If your event is planned for set up outdoors please ensure that you have a plan in place to set up elsewhere indoors as under no circumstances will Busy Little Play be set up in these conditions. Please also be aware that if there has been heavy rain prior to the event that we may not set up outside if the area is wet and soggy.

 

During the warmer months outdoor set ups will require shelter from the sun as equipment can become extremely hot. Busy Little Play does not currently provide marquees.

Busy Little Play does have an event space that can be booked if indoor space is required.

 

LOCAL PARKS AND GROUNDS

 

Please be aware that in some cases setting up in community areas and parks can require permits. This will be the responsibility of the Hirer.

 

INDEMNIFICATION

 

The Hirer agrees to indemnify and hold harmless Busy Little Play Pty Ltd and its employees, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable Lawyers fees) arising out of or in connection with the Hirers use of the equipment during the rental period, except in cases of gross negligence or wilful misconduct.

 

PHOTOGRAPHY

 

Busy Little Play reserves the right to photograph the equipment they provide at the Hirers event for promotional and marketing purposes, including but not limited to a website, social media, and flyers. The Hirer grants Busy Little Play the irrevocable and unrestricted right to use these photographs without any compensation or approval.

 

HANDLING EQUIPMENT PROBLEMS

 

If the equipment does not function properly or the Hirer does not fully understand the operating instructions provided, the Hirer will cease any use of the equipment on the event date.

 

RESCHEDULING AND CANCELLATION

 

The Hirer may request to reschedule the event to a mutually agreed-upon date and time, subject to Busy Little Plays availability. This needs to be made in writing to busylittlelay@gmail.com

Here's what happens if you decide to cancel:

If cancelled with more than seven (7) days' notice: Your Booking Retainer can be applied as a credit for use within twelve months from your secured date that is booked.

If cancelled with less than seven (7) days' notice: The Booking Retainer is non-refundable.

If cancelled with less than forty-eight (48) hours' notice: You will forfeit the full hire fee and only the Bond will be returned via bank transfer.

If you need to postpone your event, we'll consider it a cancellation. It's important to have a wet weather plan including an indoor option. Busy Little Play does not refund for any weather related issues. Also, we reserve the right to cancel this agreement if we feel you as the Hirer are not meeting your obligations or making unreasonable demands, in our opinion. In both these cases, any payments made will not be refunded.

 

COMPLIANCE WITH LAW

 

The Hirer agrees not to use the soft play equipment in an illegal or unsafe manner. The Hirer will comply with all laws and regulations governing the use of the rental equipment during the stated rental period. The Hirer is responsible for paying any fees, permits, licenses, fines, or taxes resulting from using the equipment prior to its use. This contract supersedes any oral agreements, understandings, or communications previously made. Any modifications or amendments to this Contract must be made in writing and signed by both parties to be considered valid. If a breach of the Contract occurs, Busy Little Play reserves the right to terminate the Contract, and all monies given are non-refundable. By booking and paying your booking deposit, both parties acknowledge and agree to the terms and conditions stated in this Contract.

SOFT PLAY RULES OF USE

The Client and all participants must adhere to the following rules:

You must have adult supervision at all times.

Avoid overcrowding equipment.

Shoes must be removed before entering the soft play area.

No high heels as they damage mats.

Absolutely no sharp objects (keys, eyeglasses, badges)

No pets allowed in or around the soft play area.

Strictly no food and drinks as this stains and damages equipment.

Only children under 5 can play on equipment (about 50kg).

No silly string, play dough or slime.

The client is responsible for providing a suitable spot for the setup of the soft play equipment. This area should be free of any debris or glass and cannot be on dirt or gravel. The equipment should be placed under a shaded area to avoid damage from hot temperatures.

Adults should not lean, stand on, or sit on the soft play equipment.

For the purpose of this agreement, adults refer to those aged 15 and up.

Smoking, BBQ's and open flames is prohibited near the soft play area.

Report any damage immediately.

No altering of equipment by adding or sticking on vinyl without prior arrangement.

Our safety rules sign is to remain at the front at all times.
