Busy Little Play Terms and Conditions

These Terms and Conditions apply to bookings made with Busy Little Play Pty Ltd, trading as Busy Little Play (“Busy Little Play”, “we”, “us” or “our”).

The person or organisation making the booking is referred to as the “Hirer” or “Customer”.

By submitting a booking, making a payment, selecting the agreement checkbox or signing a hire agreement, the Hirer confirms that they have read, understood and accepted these Terms and Conditions. The Hirer is responsible for ensuring that all guests, supervisors and equipment users comply with them.

 

1. Booking confirmation and payment

A booking is not secured until:

  • The deposit or payment amount shown at checkout has been received; and

  • Busy Little Play has issued written booking confirmation.

Dates are not held without the required checkout payment.

If the Hirer chooses to pay a deposit, the remaining balance must be paid in full no later than 14 full days before the event. Bookings made within 14 days of the event must be paid in full at the time of booking unless otherwise agreed in writing.

If the Hirer chooses to pay in full, the amount that would otherwise have been payable as the deposit will be treated as the booking deposit for cancellation purposes.

Customer-requested additions, package changes, venue changes, extended hire, difficult access requirements or additional delivery requirements may incur additional charges. These will be quoted and must be approved before being added to the booking.

2. Hire period

The standard equipment hire period is five hours unless otherwise stated in the selected package or agreed in writing.

The hire period begins and ends at the times confirmed in the booking.

Delivery may commence from 7:00 AM. The latest standard collection time is 5:00 PM.

Collection after 5:00 PM is subject to availability and prior written approval. A $49 after-hours collection fee may apply.

Delivery, installation and pack-down times are separate from the Customer’s agreed five-hour use period unless otherwise confirmed.

The Hirer must ensure that the equipment is ready and accessible for collection at the agreed time and that all children and guests have left the play area before pack-down begins.

3. Delivery fees

Off-site delivery is available for bookings with a minimum equipment hire value of $500, excluding delivery fees and any security bond.

Delivery, setup and pack-down are complimentary within 15 km of our Hillcrest 4118 warehouse for bookings meeting the minimum hire value.

Delivery fees outside 15 km account for the transport required to deliver, return to the warehouse, attend for pack-down and return the equipment to the warehouse.

Additional charges may apply for tolls, restricted parking, loading docks, stairs, long carrying distances or access conditions that require additional staff, time or equipment. Where practicable, these charges will be communicated and approved before proceeding.

4. Delivery access and setup area

The Hirer must provide complete and accurate information about the delivery address, parking, stairs, lifts, gates, access distances, venue restrictions and setup surface.

The Hirer must ensure that:

  • Legal and suitable parking is available reasonably close to the setup area.

  • The delivery route is clear, safe and accessible.

  • The setup area is available at the agreed time.

  • The area is flat, clean, dry and free from furniture, animal waste, mud, gravel, debris and hazards.

  • There is sufficient clear space for the selected package and its required safety clearance.

  • Any venue, property-owner or council permission has been obtained.

If the conditions on arrival materially differ from the information provided, Busy Little Play may adjust the layout, remove unsuitable items, charge reasonable additional labour costs or decline an unsafe setup.

Equipment must not be used until Busy Little Play has completed the installation and safety briefing.

5. Inspection and safety briefing

The Hirer or their nominated responsible adult must inspect the equipment after installation and before use.

Any visible damage, missing items, instability or concerns must be reported before use begins.

Busy Little Play will provide a safety and usage briefing. The Hirer must follow the briefing and communicate the rules to all guests and supervising adults.

Use of the equipment after installation indicates that it has been received in satisfactory visible condition, subject to any hidden fault, inherent defect or right that cannot legally be excluded.

6. Security bond

Busy Little Play may require a refundable security bond. Where applicable, the amount and payment arrangements will be shown during booking or communicated in writing.

Security bonds and payment authorisations will be processed through an approved payment provider. Busy Little Play will not request or store complete customer card numbers in its booking form or hire agreement.

The bond may be used toward reasonable costs arising from:

  • Equipment damage caused during the hire.

  • Lost or missing equipment.

  • Unapproved movement, alteration or removal of equipment.

  • Excessive soiling or specialist cleaning.

  • Undisclosed access conditions resulting in additional labour.

  • A material breach of these Terms and Conditions.

Normal wear and tear, pre-existing damage, inherent faults and damage caused by Busy Little Play are not chargeable to the Hirer.

Any deduction will be itemised and communicated in writing. If the reasonable cleaning, repair or replacement cost exceeds the bond, the Hirer is responsible for the additional amount.

Where no deduction is required, Busy Little Play will initiate the bond release or refund within 48 hours after inspection. Bank and payment-provider processing times may vary.

7. Care, loss and damage

All equipment remains the property of Busy Little Play.

The Hirer is responsible for taking reasonable care of the equipment during the hire period and keeping it safe, dry and secure.

Equipment must not be:

  • Removed from the agreed setup area or delivery address.

  • Moved, relocated or reconfigured after installation.

  • Stacked or placed on top of other equipment.

  • Placed on fencing, ball pits or other items.

  • Dismantled, modified, painted, marked or altered.

  • Sub-hired, loaned, sold or provided to another person.

  • Used for anything other than its intended purpose.

The Hirer is responsible for reasonable cleaning, repair or replacement costs where loss or damage is caused by misuse, prohibited products, moving or stacking equipment, inadequate supervision, negligent conduct or breach of these Terms.

All damage, loss, contamination or missing items must be reported immediately. The Hirer must not attempt to repair damaged equipment.

8. Soft-play age and weight limits

Soft-play equipment is designed for children under five years of age.

The maximum permitted user weight is 50 kg per person. Adults and children who exceed the age or weight limit must not use, climb, sit or stand on the play equipment.

Package capacity limits must be followed. The supervising adult must prevent overcrowding and carefully manage play where children of different ages and sizes are using the area.

9. Adult supervision

A responsible adult aged 18 years or over must actively supervise the play area at all times.

The supervisor must be capable of intervening immediately, must not be intoxicated and must ensure that all safety rules are followed.

Busy Little Play staff do not replace parental, carer or Hirer supervision unless a separately staffed service has been expressly included in the booking.

Children must never be left unattended.

10. Soft-play rules

The following rules apply throughout the hire:

  • Clean socks must be worn at all times by every child and adult entering the play area.

  • Shoes, high heels and bare feet are not permitted.

  • Adults may enter to supervise but must not climb, play, sit, stand or lean on soft-play shapes, ball pits, fencing, ride-ons or other play equipment.

  • No food, drinks, chewing gum or lollies are permitted in or near the play area.

  • Face paint, glitter, confetti, streamers, silly string, bubbles, slime, paint, pens and markers are prohibited.

  • Sharp, loose or potentially damaging objects must be removed before entry.

  • Toys, pets and animals are not permitted in the play area.

  • No pushing, wrestling, flips, gymnastics, rough play, unsafe jumping or intentional collisions.

  • Equipment must only be used for its intended purpose.

  • Equipment must not be moved, removed, rearranged or stacked on top of other items.

  • Children must not climb, sit or stand on the safety fencing.

  • No smoking, vaping, barbecues, open flames, heaters or heat sources are permitted near the equipment.

  • Ball-pit balls must be returned to the ball pit before collection.

  • Equipment must not be used if it becomes wet, damaged, unstable or unsafe.

If food, drink, bodily fluids, face paint or another prohibited substance comes into contact with the equipment, the Hirer must notify Busy Little Play immediately. Reasonable specialist cleaning or replacement charges may apply.

Children displaying vomiting, diarrhoea, fever or another contagious illness must not use the equipment.

11. Weather and outdoor bookings

Soft-play equipment must not be installed or used in rain, on wet ground, during unsafe winds or in extreme weather.

Outdoor bookings must have a suitable indoor or fully protected backup area large enough for the selected package. A gazebo alone may not provide adequate wet-weather protection.

The Hirer must provide appropriate shade during hot weather. Equipment must not be used if its surface becomes hot enough to cause discomfort or injury.

Busy Little Play may delay, modify, relocate or decline an installation where the weather, surface or location is unsafe.

If conditions deteriorate after setup:

  • Stop use immediately.

  • Keep children and guests away.

  • Do not move or stack the equipment.

  • Contact Busy Little Play immediately.

Weather-related cancellations or rescheduling will be managed under these Terms, the Rescheduling Policy and any rights available under the Australian Consumer Law.

12. Parks and public spaces

The Hirer is responsible for obtaining all required council permits, venue approvals and landowner permission.

The Hirer must confirm that commercial suppliers are permitted to access the location and must arrange any required parking permits, loading access or site induction.

Failure to obtain the necessary permission does not automatically entitle the Hirer to a refund or credit, subject to any right or remedy available under Australian law.

13. Equipment faults and incidents

If equipment appears damaged, unstable or unsafe, stop use immediately and contact Busy Little Play.

All injuries, incidents, near misses, equipment damage and missing items must be reported as soon as possible. In an emergency, contact emergency services on 000 before contacting Busy Little Play.

The Hirer must provide reasonable information about any incident and must not continue using affected equipment until Busy Little Play confirms that it is safe.

14. Customer cancellations

Cancellation requests must be made in writing.

​

At least 14 full days before the event

The Customer will receive a booking credit for amounts paid, valid for 12 months from the original event date. The credit is subject to availability and may not cover later package changes, delivery changes, personalised products or supplier price increases.

​

Fewer than 14 full days but at least 48 hours before the event

No cash refund will be provided. The booking deposit is forfeited due to staffing, scheduling, preparation and administration already allocated to the booking.

Any remaining payment received will be held as booking credit valid for 12 months, less approved personalised, third-party or nonrecoverable costs already incurred.

Fewer than 48 hours before the event

The full booking fee is forfeited and no booking credit will be issued. Any refundable security bond will be returned, less any properly chargeable amount.

These cancellation provisions do not apply where Busy Little Play is unable to provide the agreed service or where the Customer is entitled to a remedy under the Australian Consumer Law.

15. Customer-requested rescheduling

A rescheduling request must be made at least 14 full days before the scheduled booking date.

One reschedule is permitted per booking without an administration fee, subject to availability. The replacement event must take place within 12 months of the original event date.

If the preferred replacement date is unavailable, the Hirer may select another available date or retain the original booking date.

Payments already received will be transferred to the approved replacement date. The original confirmed package price will remain unchanged. Customer-requested changes to the package, location, delivery requirements or optional extras will be quoted separately.

Requests made fewer than 14 full days before the booking will be considered case by case. If Busy Little Play can accommodate the change, a single $49 late-rescheduling administration fee will apply only after the Hirer agrees to proceed.

A rescheduling request is not confirmed until Busy Little Play provides written confirmation. Until then, the original booking date remains in place.

These restrictions do not apply where the change results from Busy Little Play being unable to provide the agreed service or where the Customer is entitled to a remedy under the Australian Consumer Law.

16. Liability and responsibility

The Hirer acknowledges that active children’s play carries inherent risks and agrees to ensure appropriate supervision and compliance with all safety instructions.

Each party remains responsible for loss, damage, injury or expense to the extent caused by that party’s negligence, unlawful conduct or breach of these Terms.

To the extent permitted by law, the Hirer indemnifies Busy Little Play against third-party claims, reasonable costs or damage to the extent caused by:

  • The Hirer’s negligence or breach.

  • Inadequate supervision.

  • Misuse, movement or alteration of equipment.

  • Use by persons outside the stated limits.

  • Failure to follow the safety briefing.

  • A guest’s conduct for which the Hirer is responsible.

This indemnity does not apply to the extent that a claim or loss was caused by Busy Little Play’s negligence, breach, inherent equipment fault or failure to provide the service with due care and skill.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded.

17. Photography and marketing

Busy Little Play may photograph the completed equipment setup only where the Hirer has provided permission through the booking form or in writing.

Equipment-only photography will avoid identifiable guests and children wherever practicable.

Photographs or recordings containing identifiable children or guests will not be used for marketing without separate express permission.

Declining photography permission will not affect the booking.

18. Privacy

Busy Little Play collects personal information required to process bookings, deliver services, manage payments, communicate with Customers and meet legal obligations.

Payments and security bonds are handled using approved payment providers. Busy Little Play does not request complete card numbers through its booking form.

Personal information will be handled securely and retained only for as long as reasonably required, subject to legal and accounting obligations.

Marketing communications will only be sent where the Customer has provided the required consent. Customers may unsubscribe at any time.

19. Busy Little Play Space venue conditions

The following additional conditions apply when the booking includes hire of the Busy Little Play Space.

​

Venue access

Access is permitted only during the confirmed hire window. Early access and late departure require prior approval and may incur additional charges.

All guests, suppliers, decorations, rubbish and Customer-owned items must be removed by the agreed finish time.

Permitted use

The venue may only be used for the purpose confirmed in the booking.

Smoking, vaping, open flames, glitter and confetti are not permitted.

The Hirer must follow all occupancy, emergency, safety and staff instructions.

Children must be actively supervised at all times.

External suppliers

External suppliers and vendors must be approved before the event.

Busy Little Play may request evidence of appropriate public liability insurance, licences, qualifications or safe-work documentation.

The Hirer is responsible for ensuring that approved suppliers comply with venue access times and rules.

Cleaning and rubbish

The venue must be left reasonably clean and in the condition in which it was provided.

All rubbish, food, decorations and personal items must be removed or placed in the designated disposal area.

Reasonable additional cleaning, rubbish-removal, repair or replacement costs may apply where the venue is left excessively dirty or damaged.

Noise and conduct

The Hirer must ensure that guests behave respectfully and do not cause excessive noise, nuisance, unsafe conduct or damage.

Music and entertainment must finish by the confirmed hire finish time.

Busy Little Play may stop unsafe or unlawful conduct. Serious or continuing breaches may result in the event ending early without credit or refund, subject to Australian law.

Venue equipment

Venue furniture, play equipment and fixtures must not be moved, removed, modified or stacked without approval.

The Hirer is responsible for reasonable repair or replacement costs where damage is caused by the Hirer, their guests or their suppliers.

20. Australian Consumer Law

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Where Busy Little Play is unable to provide the agreed service, or where services are not provided with due care and skill, the Customer may be entitled to a remedy under the Australian Consumer Law.

21. Governing law

These Terms and Conditions are governed by the laws of Queensland, Australia.

If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply.
